By commissioning me, you agree to the following Terms of Service. Terms are susceptible to change if discussed with me before the commission has been started/completed.
I, the artist, have the right to refuse projects and requests according to my discernment and capabilities. Some content that I will not be comfortable representing include: Politically charged work, Furry/furries, hyper-realism, explicit pornographic NSFW work, Loli or underage representations, gore or excessively violent, copying other's styles, gender identities and cultures that I feel I may not be able to accurately or authentically portray or represent well.
I, the artist, warrant that the work will be my original work performed to the best of my ability.
General Terms
Artwork copyright is protecting my original work, and is defined as a tangible object, such as paper, canvas, or digital medium.
Clients may not at any time modify, edit, change the work without permission from me, the artist. Client may also not use any artwork created to train Artificial Intelligence Bots, Machine Learning Training, NFTs, blockchain or any profit platforms or purposes. Such usage is completely prohibited and may result in legal action being taken.
When providing information, please be as clear and specific as possible; references are helpful but not absolutely necessary. If you have the idea in your head, I will do my best to recreate.
Rude, sexist, offensive, or ill behavior towards me will not be tolerated and your commission will be cancelled without a refund of the down payment.
I have the power to decline your commission if I choose to do so. I do not have to specify my reason for doing so.
Commercial use and reselling rights are not included unless specified in the commission information, upon which an additional charge of 2x the commission rate will be requested to grant the client with commercial privileges. Commercial means usage on monetized streams, broadcast content, or any monetized work ( i.e. merchandise, monetized videos, music releases, etc.); and reselling rights means selling the work to another party or platform.
Communication
I will use email (jaydoodles01@gmail.com), Instagram DMs, Discord DMs, or Twitter (X) DMs to facilitate communications. I will typically respond quickly but may also take up to a week to respond in case of life events.
Communication will take place throughout the entire project timeline with updates and bouncing ideas. I will typically ask for feedback or approval after certain stages in the production process. I will let you know if there are any delays in the project timeline as well.

Payment
I may require a 50% down payment for large commissions, and the rest once the project is completed. You will receive the commission after payments are completed.
A down payment is for the safety of my time and supply cost should a commission be cancelled before completed.

A refund cannot be requested after I start the commission. If for any reason I see that I am unable to continue your commission, I will refund you 100% or offer an alternative, such as another type of artwork.
You do not have the right to demand a refund after I have completed the commission.

Claiming dissatisfaction with the finished piece does not warrant a refund as the commissioner has had the entire process to voice concerns and give critique. Doing this will result in being blacklisted.
If you submit a chargeback claim against me after receiving your work, I retract all rights to the commission, you will be unable to commission me again, and you will be blocked from contacting me, and be blacklisted.

Process
I will provide in progress images of the work, allowing for changes along the way.
Large changes will require an additional charge, cost depending on the extent of the changes requested.
Projects may last up to 6 months depending on outside factors such as size/complexity of the commission, health/mental health, life events, and family emergencies. If something does happen, I will inform you as soon as possible so we can plan for the completion or refunding of the commission.
Customer Satisfaction
I will do my best to make sure my customers are happy. Once a commission is completed, only small changes or fixing minor mistakes will be allowed within a month of completion.
The in-progress shots are meant to eliminate post-completion alterations, so large changes will not be allowed.
I am only one person and I chatting all day would be fun, but my time is very limited and excess conversation will be kept to a minimum. This is a business transaction, but I still wish to remain friendly towards everyone so please understand if I do not respond immediately.
If you are unhappy with your work, please let me know before the commission is completed.
Copyright/Usage Policy
- I, the artist, hold the rights to the works I produce. I may use images from your commission to:
Promote myself on social media or websites
Display/perform where I would like
Print copies (if applicable) to sell/distribute
Make works that derive from the original (This does not apply to your personal Original Characters)
-The commissioner is able to:
Print the art for personal use
Take pictures of the work
Claim right to their Original Character(s), but not the drawing itself
Post on social media
If commission pertains to personal merchandise and is discussed before the commission began, the commissioner is allowed to sell the image as their merchandise, but my signature must be included somewhere in the image. Commercial rights will double the original price of the commission unless stated otherwise by me.
Copyright infringement will be classified as the following:
Copying the artwork and selling it as your own
Reproducing, distributing, or publicly displaying the work without my permission
Altering the artwork without my permission
Removing my signature
You do own the artwork, but I still own the copyright to the work.
Clients are granted exclusive rights for personal use of the work as agreed upon. Personal use includes: social media profile pictures, signatures, layouts, themes, wallpapers, personal website display, social media posts, physical prints and products that is not for sale or distribution to any other party.
